Article 2 – Purpose and Scope
These Terms and Conditions of Sale ("Terms") govern the sale of all products offered by Pétanque Sportif, including pétanque boules, clothing, accessories, and any other products available through the website petanquesportif.fr, to any purchaser ("Customer").
By placing an order on this website, the Customer acknowledges having read and accepted these Terms in full.
Pétanque Sportif reserves the right to amend these Terms at any time. The Terms applicable to an order are those in force on the date the order is placed.
Article 3 – Products and Availability
The products offered for sale are those displayed on the website at the time the Customer places an order.
While Pétanque Sportif makes every effort to ensure that product information is accurate and up to date, it cannot guarantee the accuracy or completeness of descriptions provided by manufacturers.
If a product becomes unavailable after an order has been confirmed, the Customer will be informed by email as soon as possible. The Customer may choose to:

receive a full refund within 14 days, or

accept a substitute product of equivalent quality and value, where available.
Product photographs, images, and illustrations are provided for guidance only. Minor variations in colour, finish, or appearance may occur and shall not be considered defects.
Article 4 – Prices
All prices are displayed in euros (€) and include all applicable taxes (VAT), unless otherwise stated.
Shipping costs are not included in the listed prices and are calculated separately before the Customer confirms the order.
Pétanque Sportif reserves the right to modify prices at any time. However, products will be invoiced at the price displayed when the Customer confirms the order.
Article 5 – Orders
The ordering process consists of the following steps:

Selecting products and adding them to the shopping cart;

Reviewing the contents of the cart;

Entering billing and shipping information;
-
Selecting a delivery method;
-
Choosing a payment method and confirming payment;

Receiving an order confirmation by email.
The sale becomes final once payment has been successfully authorized and accepted.
A confirmation email summarizing the order, including the products purchased, prices, and delivery address, will be sent to the Customer as soon as possible.
Pétanque Sportif reserves the right to refuse or cancel any order in the event of suspected fraud, an obvious pricing error, or product unavailability. In such cases, the Customer will be informed promptly and, where applicable, any payment received will be fully refunded.
Article 6 – Payment
Payment is due in full at the time the order is placed.
The following payment methods are accepted:

Credit and debit cards (Visa, Mastercard, American Express) through the secure Shopify Payments / Stripe payment platform;

Any other payment methods made available during the checkout process.
All online payments are secured using SSL encryption. Pétanque Sportif does not store the Customer's banking or payment details.
If a payment is declined or suspected to be fraudulent, the order will be automatically cancelled, and the Customer will be notified accordingly.
Article 7 – Delivery
Delivery methods, estimated delivery times, and shipping rates are detailed in our Shipping Policy.
For deliveries to pickup points, Customers must select their preferred pickup location on the order confirmation page. This selection is required before the order can be shipped.
Orders are dispatched through Sendcloud, which selects the most appropriate shipping carrier.
Estimated delivery times are as follows:

Paris (France): 24-hour home delivery for in-stock items, or 3–4 business days for made-to-order products;
-
Metropolitan France (excluding Paris): 3–4 business days;

European Union: Standard delivery times depending on the destination and selected carrier;

Made-to-order products: Delivery times vary depending on supplier availability. Customers will receive an email confirmation once the order has been shipped.
Delivery times are estimates only and do not constitute a contractual guarantee. Pétanque Sportif shall not be held liable for delays caused by shipping carriers or events beyond its reasonable control, including adverse weather conditions, strikes, customs delays, or other force majeure events.
Free shipping is available for:

Orders over €250 within Metropolitan France;

Orders over €300 within the European Union.
Pétanque Sportif Apparel (P.S. Collection)
Textile products from the Pétanque Sportif collection are manufactured on demand through our production partner.
Shipping costs are calculated automatically according to the total weight of the order and displayed during checkout.
Estimated shipping costs:

1 lightweight item (cap, beanie, etc.): approximately €3.90

1 T-shirt or polo shirt: approximately €4.80

2 items: approximately €6.90
-
3 items: approximately €8.00
-
4–5 items: approximately €9.00–€30.00

6–10 items: approximately €12.00–€45.00
For orders of more than 10 items, please contact us at contact@petanquesportif.fr for a custom shipping quotation.
Estimated delivery time for made-to-order apparel is 10–14 business days after production.
Additional Production Time for Engraved Products
Orders including engraved pétanque boules, equipment, or any other personalized products require an additional 2–3 business days for production.
This additional lead time applies to all shipping methods, including express delivery.
Transfer of Risk
The risk of loss, theft, or damage to the products transfers to the Customer once the goods have been handed over to the shipping carrier.
If a parcel arrives damaged or incomplete, the Customer must make appropriate reservations with the carrier upon delivery and notify Pétanque Sportif within 48 hours of receipt by email at contact@petanquesportif.fr.
Article 8 – Transfer of Ownership
Ownership of the products shall remain with Pétanque Sportif until full payment of the purchase price has been received, regardless of the delivery date or the transfer of risk.
Article 9 – Right of Withdrawal
In accordance with applicable consumer protection laws, Customers purchasing as consumers have the right to withdraw from their purchase within 30 days of receiving the products, without providing any reason and without incurring any penalties.
To exercise this right, the Customer must notify Pétanque Sportif by email at contact@petanquesportif.fr, preferably using the withdrawal form provided below (where applicable), or by any other clear statement expressing their decision to withdraw.

Returned products must be:

unused;
-
in new condition;
-
complete;
-
in their original packaging.
Return shipping costs are the responsibility of the Customer.
Once the returned products have been received, or proof of shipment has been provided, Pétanque Sportif will refund the purchase price of the returned products (excluding the original shipping costs) within 14 days, using the same payment method used for the original transaction.
The right of withdrawal does not apply to personalized products or products manufactured according to the Customer's specifications.
Article 10 – Statutory Warranties
All products sold on petanquesportif.fr benefit from the statutory warranties provided under applicable French law.
Legal Guarantee of Conformity
Customers are entitled to the Legal Guarantee of Conformity, which applies for two (2) years from the date of delivery of the goods.
Where the conditions set out by law are met, the Customer may request the repair or replacement of the defective product. If neither solution is possible or proportionate, the Customer may be entitled to a full or partial refund in accordance with applicable legislation.
Warranty Against Hidden Defects
Customers also benefit from the statutory warranty against hidden defects, allowing them to request cancellation of the sale or a reduction in the purchase price if a hidden defect renders the product unsuitable for its intended use.

Article 11 – Liability
Pétanque Sportif shall not be liable for damages resulting from:

improper use of the products;

misuse or negligence by the Customer;

normal wear and tear;

events beyond its reasonable control (force majeure).
In all circumstances, the liability of Pétanque Sportif shall be limited to the total amount paid by the Customer for the order giving rise to the claim.
Pétanque Sportif makes every reasonable effort to ensure continuous access to its website but cannot guarantee uninterrupted availability. The company shall not be held liable for technical failures, maintenance operations, hosting issues, internet outages, or other circumstances affecting website accessibility.
Article 12 – Intellectual Property
All content available on petanquesportif.fr, including but not limited to text, photographs, graphics, logos, product descriptions, illustrations, videos, trademarks, and the overall website design, is protected by intellectual property laws.
Any reproduction, distribution, modification, publication, transmission, or commercial use of all or part of the website's content without the prior written authorization of Pétanque Sportif is strictly prohibited.
Article 13 – Personal Data Protection (GDPR)
Personal data collected during the ordering process, including the Customer's name, postal address, email address, and telephone number, is processed solely for the purposes of fulfilling orders, providing customer support, and managing the commercial relationship.
Personal data is never sold or transferred to third parties except where necessary to perform the contract, such as payment providers, shipping carriers, or other service providers involved in processing the order.
In accordance with the General Data Protection Regulation (GDPR) and applicable French data protection laws, Customers have the right to:

Article 14 – Force Majeure
Pétanque Sportif shall not be held liable for any delay or failure to perform its contractual obligations where such delay or failure results from events beyond its reasonable control, including but not limited to natural disasters, epidemics, pandemics, governmental measures, strikes, transportation disruptions, power failures, or telecommunications network outages.
Where such circumstances occur, Pétanque Sportif will inform the Customer as soon as reasonably practicable and will make every reasonable effort to find an appropriate solution.
Article 15 – Consumer Mediation and Dispute Resolution
In the event of any dispute relating to an order, the Customer is encouraged to contact Pétanque Sportif's customer service department first in order to seek an amicable resolution.

If no satisfactory solution can be reached, consumer Customers may have the right to use an independent consumer mediation service in accordance with applicable French consumer protection legislation.

These Terms and Conditions are governed by and shall be interpreted in accordance with the laws of France.
